This is a summary of a new report, ‘Report on key elements of the legislative framework affecting people with disability’.

The Australian Government Solicitor prepared this report for the Disability Royal Commission.

This report assists the Royal Commission’s work as it examines violence, abuse, neglect and exploitation of people with disability across all areas of life.

The report lists and describes key Australian laws that affect people with disability including laws about:

  • NDIS
  • disability services
  • housing
  • access to the built environment and transport
  • Australian Government payments
  • employment
  • civil justice
  • criminal justice.

The report summarises Australian laws into a number of sections.

The section on discrimination talks about laws that make it illegal to discriminate because of ‘disability’ or ‘impairment’.

The section on health talks about laws relating to the medical treatment of people with disability. These include providing medical treatment for people who are not able to consent to the medical treatment.

There is a section on restrictive practices on people with disability.

The section on quality and safeguards talks about laws that ensure services for people with disability are high quality and that rights of people with disability are maintained.
